In accordance with the Law on the Protection of Personal Data No. 6698 (“Law”), EVEN ACTIVE, ZEYNEP ÇALIŞKAN (“Company”), as the data controller, may process your personal data within the framework explained below. Your personal data is processed by our Company in accordance with the processing purposes and legal reasons specified in this disclosure text and in accordance with the law and good faith, for specific, clear and legitimate purposes, in a limited, measured and necessary manner for the purpose.

Method of Collecting Personal Data, Purpose of Processing and Legal Reason

Your personal data is collected electronically within the scope of fulfilling the purposes stated below (“Purposes”) through the filling of the online participation form/contact form/application form, call center, our mobile applications, text message, e-mail and through interviews and forms conducted when you contact our Company in a physical environment.

Your personal data is collected and processed by our Company for the following purposes and legal reasons based on the personal data processing conditions specified in Article 5 of the Law.

Provided that it is directly related to the establishment or execution of a contract, based on the legal reason that the processing of personal data belonging to the parties to the contract is necessary;

• Your identity, communication, financial, customer transaction data for opening sales records and performing billing activities,

• Your identity, communication, customer transaction, financial data for the establishment or execution of the sales contract due to your purchase of our Company's products and services.

Based on the legal reason that it is clearly prescribed by law and mandatory for the data controller to fulfill its legal obligation;

• Your identity, communication, finance, customer transaction data for the preparation of invoices for goods and services you receive within the framework of the Tax Procedure Law,

• Your identity, communication, customer transaction data for the fulfillment of official institution requests,

• Your identity, communication, customer transaction data for the provision of information to authorized institutions arising from the legislation,

• Your transaction security data for the compliance with the storage obligations stipulated in the legislation,

• Your identity, communication, customer transaction, request and complaint data for the response to the applications of the relevant person in accordance with the legislation and the execution of the necessary transactions.

Based on the legal reason that data processing is mandatory for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the relevant person;

• Your identity, communication, customer transaction, financial data for keeping accounting records and monitoring financial transactions due to being a customer of the store and website,

• Your identity, communication, customer transaction, request and complaint data for our business units to carry out the necessary work to benefit the relevant persons from the products and services offered by our Company, including sales and marketing activities of our products and services, and for the execution of relevant business processes,

Based on the legal reason that data processing is mandatory for the establishment, use or protection of a right;

• For the receipt, evaluation and finalization of your requests and complaints, your identity, communication, customer transaction, request and complaint, finance, legal transaction, transaction security data for the storage of personal data during the general statute of limitations in order to constitute evidence in possible disputes that may occur in the future.

Processing your identity, communication, customer transaction, request and complaint data for the purpose of contacting you and carrying out the marketing processes of our Company's products and services, customizing the products and services offered by our Company, including profiling and analysis activities, according to the tastes, usage habits and needs of the relevant persons and recommending and introducing them to the relevant persons,

Processing your identity and contact information by Zeynep Çalışkan for the purpose of sending advertisements, promotions etc. commercial electronic messages to your contact information through the communication channel you prefer.

To Whom and for What Purposes Can Processed Personal Data Be Transferred

Your personal data collected in line with the fulfillment of the above-mentioned Purposes may be transferred within the scope below, within the framework of the personal data processing conditions and purposes specified in Article 8 of the Law.

• Based on your explicit consent, your identity and contact information may be transferred to your contact information through the communication channel you prefer by these companies for advertisements, promotions etc. with Zeynep Çalışkan companies for the purpose of sending commercial electronic messages

• Based on legitimate interest, to ensure that the relevant persons benefit from the products and services offered by our Company, including sales and marketing activities of our products and services, to our business partners, suppliers, group companies resident in Turkey for the necessary work to be carried out by our business units and the execution of relevant business processes,

• Within the scope of being clearly foreseen in the laws and fulfilling our legal obligations, to legally authorized public institutions and legally authorized private persons.

Rights of the Relevant Person Listed in Article 11 of the Law

By applying to us, you can;

a) You have the right to learn whether it has been processed,

b) If it has been processed, to request information,

c) To learn the purpose of processing and whether it is used in accordance with its purpose,

d) To know the third parties to whom it was transferred domestically/abroad,

e) To request correction if it is processed incompletely/incorrectly,

f) To request deletion/destruction within the framework of the conditions stipulated in Article 7 of the Law,

g) To request notification of the transactions made pursuant to clauses (e) and (f) above to the third parties to whom it was transferred,

h) To object to the emergence of a result against you due to analysis exclusively by automatic systems,

i) To request compensation for the damages in case you suffer damages due to processing contrary to the Law.

In order to exercise your rights, complaints made by Data Owners whose Personal Data are processed by Zeynep Çalışkan will be answered and finalized by Zeynep Çalışkan companies as soon as possible and within 30 days at the latest. Data Owner can make their requests and complaints to [email protected] in person, provided that the identity is checked by the Zeynep Çalışkan company's KVK team, or by proxy, provided that a notarized power of attorney is presented, and provided that a secure electronic signature is used, and by registered electronic mail addresses.
